A Simple Guide to Ohio’s Mayor’s Court System

Across Ohio, a number of towns and villages run their own small-scale court system called the Mayor’s Court. These courts work quite differently from standard courts of record, and they don’t sit directly under the regulatory authority of the Ohio Supreme Court. That said, they still have to follow the rules the Supreme Court sets in order to operate within the bounds of the law.

Under the Ohio Revised Code § 1905.03, every Mayor’s Court is required to register with the Ohio Supreme Court before it can legally carry out its duties.

So why do these courts exist? Mayor’s Courts come with a handful of perks, the biggest being local control over legal matters. For many people, handling a case close to home beats traveling to deal with far-off authorities. Still, it’s worth remembering that these courts have clear boundaries on the kinds of cases they’re allowed to take on. A seasoned Jefferson Ohio criminal lawyer can help you understand exactly where those boundaries fall.

The Youngstown Criminal Law Group is home to talented attorneys who bring years of hands-on experience to courtrooms throughout Jefferson, Ohio. Your Mayor’s Court Questions, Answered

Mayor’s Court vs. Municipal Court

A Municipal Court is what’s known as a “court of record.” That means cases can be heard by a jury, and the proceedings are documented so they can be used later if you decide to appeal. Mayor’s Courts operate on a smaller scale. They don’t hold jury trials, and their proceedings aren’t recorded for the purpose of appeals to a higher court.

Your Right to a Lawyer

You’re entitled to a defense attorney only in cases where jail time is a possible outcome. That said, nothing stops you from hiring a lawyer for any Mayor’s Court appearance, regardless of the charge. In fact, judges will often grant a continuance—essentially a delay—to give you time to find a skilled Jefferson Ohio criminal lawyer and prepare your defense properly.

Asking for a Jury Trial

Since Mayor’s Courts don’t offer jury trials, requesting one changes things. If you ask for a jury trial, your case will simply be moved to the appropriate Municipal Court within the Ohio jurisdiction, where a jury can hear it.

Appealing a Mayor’s Court Ruling

Not happy with how your Mayor’s Court case turned out? You have the right to a fresh start. Your case can be retried at the municipal court, where it begins from scratch—the new court won’t lean on anything that happened during the earlier proceedings. Speaking with a Jefferson Ohio OVI attorney early can make a real difference if you’re considering this route.

Charges Often Heard in Mayor’s Court

The kinds of cases that regularly come before Mayor’s Courts include, but aren’t limited to:

  • Illegal sales to minors
  • Reckless operation of a vehicle
  • Open container violations
  • Street racing
  • Operating a Vehicle under the Influence (OVI)
  • Criminal mischief
  • Traffic control at intersections
  • Operating a vehicle at stop and yield signs
  • Marijuana cultivation
  • Drug possession
  • Possession of drug paraphernalia
