Sex Offender Categories in Columbiana County, Ohio

In the state of Ohio, sex offenders in Columbiana County are classified into two distinct categories based on the nature of their sexual offenses. These categories include:

  • Sex Offender: This category applies to individuals who have been convicted or pleaded guilty to a criminal sexual offense.
  • Child-Victim Offender: This category pertains to individuals who have been convicted or pleaded guilty to an offense against a child or children under the age of 18, without any sexual motivation.

Ohio’s Sex Offender Registration Requirements

In Ohio, individuals who fall into the categories of sex offenders or child-victim offenders are assigned to different tiers based on the severity of their offenses and the length of time they are required to register. These tier classifications help enforce appropriate registration requirements. Child-victim offenders have their own separate tiers to specifically address the seriousness of their crimes.

Tier 1

A Tier 1 offender is obligated to register every 12 months for a period of 15 years. Unlike other tiers, Tier 1 offenders are not required to fulfill neighborhood or community requirements. The following types of convictions fall under Tier 1:

  • Sexual imposition
  • Child enticement with sexual motivation
  • Illegal use of a minor in nudity-oriented material or performance
  • Pandering obscenity
  • Voyeurism
  • Gross sexual imposition
  • Importuning
  • Unlawful restraint with sexual motivation
  • Menacing by stalking with sexual motivation
  • Unlawful sexual conduct with a minor that is non consensual, with the offender being less than four years older than the victim and having no prior sexual offense convictions

Tier 2

Tier 2 offenders have to register every 180 days for a span of 25 years. They are not obligated to fulfill neighborhood or community requirements. Convictions that fall under Tier 2 include:

  • Kidnapping with sexual motivation
  • Child endangering
  • Gross sexual imposition with a victim under 13
  • Compelling prostitution
  • Pandering obscenity involving a minor
  • Pandering sexually oriented material involving a minor, with the alleged offender being at least four years older than the victim
  • Illegal use of a minor in nudity-oriented material or performance
  • Any sexual offense that occurs after the offender has been classified as a Tier 1 offender

Tier 3

Tier 3 offenders have the most stringent requirements and are mandated to register every 90 days for the duration of their lives. Additionally, whenever a Tier 3 offender relocates to a new neighborhood, the community is notified of their presence. This notification is sent to all residents living within 1,000 feet of the offender’s official address. Convictions that fall under Tier 3 include:

  • Rape
  • Sexual battery
  • Murder and aggravated murder with sexual motivation
  • Kidnapping of a minor not by a parent
  • Felonious assault with sexual motivation
  • Kidnapping of a minor to engage in sexual activity
  • Unlawful death or termination of pregnancy resulting from committing or attempting to commit a felony with sexual motivation.

Ohio’s Sex Offender Database: A Step-by-Step Registration Guide

When an individual is obligated to register with Ohio’s sex offender database, it is crucial to provide the appropriate authorities with the following information promptly:

  • Home address
  • Work address
  • Vehicle registration and license
  • Email addresses
  • Color photo
  • School or university address in the local area
  • Other identifying information

To ensure compliance with Ohio laws, sex offenders must register within three days of entering the county they plan to reside in. Moreover, if they intend to travel away from their home for seven or more days, they must notify the authorities accordingly.

If labeled as a Tier 2 or Tier 3 offender, individuals will be included in Ohio’s Electronic Sex Offender Registration and Notification (eSORN) online database. The severity of their crimes warrants public access to their information. Tier 1 offenders will only appear in the database if they have committed a qualifying offense against a minor.
